ILC Legal Director’s National Impact Litigation

Charles “Shane” Ellison, ILC’s legal director, also engages in impact litigation on behalf of National Justice For Our Neighbors (JFON), the national organization of which we are an affiliate. Shane authored amicus briefs before the Eighth and Ninth Circuit Courts of Appeal regarding application of the persecutor bar, as well as before the Board of Immigration Appeals (BIA) in the case Matter of Negusie. Amicus briefs are legal documents filed in appellate court cases by non-litigants with a strong interest in the subject matter; such briefs advise the court of relevant additional information or arguments for consideration.

In the June issue of the prestigious Georgetown Immigration Law Review (GILR), from his position as professor of the Creighton Immigrant and Refugee Clinic, Shane argues that more work is needed to safeguard refugees and asylum-seekers facing possible application of the persecutor bar, which excludes certain applicants for asylum and related protection.

“I see this as an extension of our impact litigation work.” Shane said. “My hope is that the procedural safeguards for which I advocate in this article can serve as a launch point for scholars and litigators alike to advance this crucial work of defending refugees.”
